Terms of Service

By commissioning, purchasing, or otherwise engaging ItsMoreno's development services, you agree to the following terms. Please read them carefully before proceeding.

01 Acceptance of Terms

These Terms of Service ("Terms") govern all transactions and service agreements between ItsMoreno ("Developer", "I", "me") and any client, individual, or entity ("Client", "you") who commissions or purchases services. By initiating contact for a commission, submitting payment, or otherwise engaging services, you agree to be bound by these Terms in full.

02 Services Provided

ItsMoreno offers the following services:

  • Custom Discord bot development (moderation, ticketing, economy, leveling, etc.)
  • Discord server setup, configuration, and architecture
  • Bot maintenance, updates, and feature additions
  • Hosting setup and deployment assistance

All work is performed on a commission basis. The specific scope, deliverables, and timeline are agreed upon prior to the start of any project.

03 Payments & Pricing

Pricing is determined on a per-project basis. All prices are communicated and agreed upon before work begins. The following payment conditions apply:

  • Deposits: Projects above a mutually agreed threshold may require a non-refundable deposit (typically 30–50%) before work commences.
  • Currency: Payments are accepted in USD unless otherwise agreed. Cryptocurrency or other payment methods may be accepted at the Developer's discretion.
  • No free work: Revisions beyond the agreed scope will be quoted separately and require additional payment.
  • Late payment: Delivery of source code or deployment credentials may be withheld until full payment is received.

04 Refund Policy

All sales are final once work has commenced. For the purposes of these Terms, commencement is defined as whichever occurs first: (a) the payment of a deposit, or (b) the sharing of the first technical requirement document, project brief, or written scope by either party. Refunds are not provided after commencement. If no work has started and a cancellation is requested, a partial refund may be issued at the Developer's discretion, minus any non-refundable deposit already paid. No refunds are issued for:

  • Completed and delivered projects, regardless of post-delivery changes in requirements.
  • Projects where the Client provided incorrect, incomplete, or misleading specifications.
  • Service disruptions caused by third-party platforms (Discord, hosting providers, etc.).

Chargeback notice: Any chargeback or payment dispute filed after commencement will be contested using the written scope of work and communication records as evidence.

05 Intellectual Property & Ownership

Upon full payment, the Client receives full ownership of the custom source code written specifically for their project. The following conditions apply:

  • The Developer retains the right to display the project in their portfolio unless the Client explicitly requests otherwise in writing.
  • The Developer retains all intellectual property rights over reusable internal libraries, base frameworks, utility modules, or boilerplate code used across multiple projects. The Client is granted a non-exclusive, non-transferable license to use such components solely within the context of the delivered project. This license does not grant ownership of, or rights to distribute, those underlying components independently.
  • The Client may not resell or redistribute the delivered code as a standalone template or product without prior written consent.

06 Client Responsibilities

The Client agrees to:

  • Provide accurate, complete, and timely information required to fulfill the commission.
  • Respond to communication within a reasonable timeframe (typically 48–72 hours). Prolonged unresponsiveness may result in project suspension or cancellation without refund.
  • Ensure that all requested features comply with Discord's Terms of Service and Community Guidelines.
  • Not use delivered bots or code for any illegal, harmful, or malicious purposes.

07 Prohibited Use

Services may not be used to develop, deploy, or facilitate:

  • Bots designed to spam, raid, or harass Discord users or servers.
  • Self-bots or user-bots that violate Discord's Terms of Service.
  • Any system intended to facilitate fraud, scamming, or financial exploitation.
  • Tools for distributing malware, phishing links, or unauthorized data collection.

Any commission found to be in violation of these restrictions will be immediately terminated without refund, and may be reported to Discord and relevant authorities.

08 Limitation of Liability

The Developer is not liable for:

  • Downtime, data loss, or service interruptions caused by third-party hosting providers or Discord API outages.
  • Damages resulting from the Client's misuse, modification, or improper deployment of delivered code.
  • Loss of data resulting from the Client's failure to maintain proper backups.

In no event shall the Developer's total liability to the Client exceed the total amount paid for the specific commission in dispute.

09 Delivery & Acceptance

Upon delivery of the commissioned work, the Client has 7 calendar days to review and report any bugs or defects that fall within the originally agreed scope. This period begins on the date the deliverable is sent.

  • Bugs reported within the 7-day window that fall within scope will be fixed at no additional charge.
  • After the 7-day window, the project is considered accepted in its delivered state. Any further fixes, changes, or additions are treated as new paid work.
  • Requests for features or behaviors not included in the original agreed scope are not considered bugs and are quoted separately regardless of timing.
  • Failure to respond or test within the 7-day window constitutes automatic acceptance.

10 Warranty Disclaimer

All services and deliverables are provided on an "as-is" and "as-available" basis, without warranty of any kind, express or implied. The Developer does not warrant that:

  • The delivered software will be entirely free of errors or operate without interruption.
  • Discord's API, gateway, or platform will remain compatible with the delivered code indefinitely. Discord may change or deprecate API features at any time without notice, and such changes are outside the Developer's control.
  • Third-party libraries or hosting environments used in the project will remain functional, secure, or maintained by their respective authors.

Post-delivery compatibility issues caused by Discord platform changes or third-party dependency updates are not covered under the 7-day acceptance window and will be quoted as maintenance work.

11 Indemnification

The Client agrees to defend, indemnify, and hold harmless ItsMoreno from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • The Client's use or misuse of the delivered software.
  • Any violation of Discord's Terms of Service, Community Guidelines, or Developer Policy by the Client or their server members through use of a commissioned bot.
  • Any illegal or unauthorized activity conducted through or facilitated by the delivered code after delivery.
  • Any third-party claims arising from the Client's operation of the commissioned software.

12 Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the services provided shall be resolved through good-faith negotiation in the first instance. If negotiation fails, disputes shall be subject to the jurisdiction of the courts in the Developer's country of residence, without regard to conflict of law principles.

The Client agrees that any claim or cause of action arising from these Terms must be filed within one (1) year of the event giving rise to the claim, or be permanently barred.

13 Modifications to These Terms

These Terms may be updated at any time. Changes will be reflected on this page with an updated effective date. Continued engagement with services after changes are posted constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
